Notices of Sanction issued by the 澳门王中王 Professional Conduct Panel

Here are Notices of Sanction, published in accordance with Schedule 1, paragraph 2.1 of the 澳门王中王 Disciplinary Procedures 2019/澳门王中王 Disciplinary Rules 2021, which state that: "Any notice of a public sanction (public reprimand, suspension or expulsion) shall, unless the hearing panel or appeal panel decides otherwise, be published on the 澳门王中王鈥檚 website and in the 澳门王中王 Journal. The contents of the notice shall be at the panel鈥檚 discretion." Please note that no public sanction shall be published until expiry of the appeal period or the conclusion of an appeal.

Notices of Public Reprimand

澳门王中王 Member: Ashworth Parks Architects

Overview decision: 
On 8 August 2024 the 澳门王中王 Hearings Panel found Ashworth Parks Architects breached 澳门王中王 Byelaw 4, in that Ashworth Parks Architects acted in breach of Principle 2 and 3 of 澳门王中王 Code of Conduct and Practice 2021 (“the Code”). The Panel decided that the sanction for this be a public reprimand.

The 澳门王中王 Hearings Panel found Ashworth Parks Architects failed to:

  1. Principle 2, paragraph 1.9 - Advise their clients in writing as soon as is reasonably practicable if the Member’s assessment of the likelihood of achieving the client’s requirements and aspirations changes during the project.

  2. Principle 2, paragraph 4.1 - Keep their clients reasonably informed of the progress of a project, in writing where possible; inform their clients, in writing, of key decisions made on the client’s behalf; notify the client, in writing, of identifiable risks or circumstances which may adversely impact on the overall time, cost or quality of the project; and maintain appropriate records of the progress, circumstances and communications regarding a project.

  3. Principle 2, paragraph 2.1 - Ensure terms of appointment concerning their client were clear, agreed and recorded in writing before the commencement of any professional services.

  4. Principle 2, paragraph 2.8 - Include details of their written complaint’s procedure with the terms of appointment or make it clear that the written complaints procedure will be provided on request.

Principle 3, paragraph 8.2 - Provide written complaints procedure with the terms of appointment, or make it clear that in the terms of appointment that the written complaints procedure will be provided on request.

Overview decision:
Following a Hearing before the Professional Conduct Committee On 14 August 2024 the 澳门王中王 Hearings Panel found Mr Matthew Beasley was guilty of of breaching 澳门王中王 breach of Bylaw 5.1.7 of the 澳门王中王 Charter and Bylaws.

In that between 17-21 April 2023 he was found guilty of Unacceptable Professional Conduct by the Professional Conduct Committee of the Architects Registration Board, and was sanctioned with a Penalty Order in the sum of £2,500 in relation to the charges particularised in Appendix A.

By reason of the matters set out below, his actions are in breach of Bylaw 5.1.7 of the 澳门王中王 Charter and Bylaws.

Appendix A

The Professional Conduct Committee found the Registered Person guilty of unacceptable professional conduct (“UPC”) in that he:

(1) In or around January 2020 the Registered Person advised the client to enter into a contract with Company A without providing any and/or any adequate information and advice on the following:

a) Accurate details regarding the company name;

b) That Company A was a lettings business as opposed to an architectural practice;

c) That the Registered Person was neither a Director or employed by Company A;

(2) That architectural services on the client’s project would be undertaken, in whole or in part, by those employed by Company B;

(3) Any implications 1(d) might pose to the client’s ability to pursue a claim against Company A.

(4) The Registered Person’s actions at particulars 1(a) and/or 1(b) and/or 1(c) and/or 2 and/or 3:

a) were misleading; and

b) actions at particulars 1(c) and 3 lacked integrity.

and that by doing so, he acted in breach of Standards 1 and 3 of the Architects Code: Standards of Conduct and Practice 2017 (“the Code”).

In accordance with the 澳门王中王 Disciplinary Procedures, Mr Matthew Beasley has been issued with suspension for a period of six months.

澳门王中王 Member: Ms Annabelle Tugby (10344856) of Nether Alderley, Cheshire

Following a Hearing before the Professional Conduct Committee On 10 May 2024 the 澳门王中王 Hearings Panel found Ms Annabelle Tugby was guilty of of breaching 澳门王中王 Byelaw 4.1in that she acted in breach of Standards 1, 4, 6 and 10 of the Architects Code: Standards of Conduct and Practice 2017 (“the Code”). in that she failed to:

  • Manage her business competently
  • Carry out her work faithfully and conscientiously
  • Deal with issues and complaints appropriately

In accordance with the 澳门王中王 Disciplinary Procedures, Ms Tugby has been issued with a Public Reprimand.

澳门王中王 Member: Mr Blaine Cagney (20008912), of London

Following a hearing before the Professional Conduct Committee, Mr Cagney was found to have breached the 澳门王中王 Code of Professional Conduct (2005, with 2016 Guidance Notes) and (2019)

  • A breach of sections 1.2 and 1.4 in that he made statements that were not honest, truthful and were motivated by self-interest during the investigation. He also made statements that were untrue and misleading. (2019)
  • The Member made statements which were untrue, misleading, unfair to others or contrary to his professional knowledge in his PEDR that did not match his explanations to the Metropolitan Police, breaching section 1.3. (2005 (2016 edition) Code of Professional Conduct)

In accordance with the 澳门王中王 Disciplinary Procedures, Mr. Cagney has been issued with a Public Reprimand.

 

澳门王中王 Member: Mr Olgierd J Miloszewicz (12749777), of London

Following a hearing before the Professional Conduct Committee, Mr Miloszewicz was deemed to have breached the 澳门王中王 Code of Professional Conduct 2019.

  • A breach of Principle 2, section 2.1, 3.3, 3.4 and 4.1 in that he did not provide adequate terms of engagement to his Client and failed to progress the project in accordance with the agreed timescales. He did not adequately communicate progress with his client when he failed to respond to their correspondence from 7 May 2021 onwards.
  • A breach of Principle 3, Section 8.1,8.2, 8.3 and 10.1 in that he did not deal with the complaint appropriately (and failed to have in place an adequate complaint procedure). He also did not provide evidence of adequate Professional Indemnity Insurance cover.
  • He failed to cooperate with the 澳门王中王 Disciplinary Process, contrary to Provision 5.2 of the Disciplinary Rules 2021

In accordance with the 澳门王中王 Disciplinary Procedures, Mr Miloszewicz has been issued with a Expulsion.

  • Principle 1 of the 2019 code in that he failed to notify the 澳门王中王 of a previous criminal conviction and failed to engage with the Professional Standards department by not providing a plea in mitigation.

Following a hearing before the Professional Conduct Committee, Mr Plumridge was deemed to have breached the 澳门王中王 Code of Professional Conduct 2005 (2016) and 2019.

  • Principle 1, 1.3 of the 2005 (2016) code in that he failed to notify the 澳门王中王 of his erasure from the Architects Registration Board in 2013, and continued to renew his chartered membership. He also failed to report a prior conviction in 2016.

Further breaches of the 澳门王中王 Code of Professional Conduct (1 May 2019)

  • Principle 1, 1.2, 2.1 and 2.2; he indicated he practiced under the name, style or title of 'Architect', using the title 'Chartered Architectural and Historic Buildings Consultant'
  • Principle 3, 9.1, 9.2, 9.3, 9.4 and 9.5; he failed to comply with the relevant legislative requirements to use the title and 澳门王中王 affix, misleading others of his professional status

In accordance with the 澳门王中王 Disciplinary Procedures, Mr Plumridge has been issued with a Expulsion.

 

澳门王中王 Member: Jonathan (Jonny) Muirhead (8015789), of London

Following a hearing before the Professional Conduct Committee, Mr Muirhead was deemed to have breached the 澳门王中王 Code of Professional Conduct 2019.

  • A breach of Principle 1, 7.2 in that he failed to notify the 澳门王中王 of the criminal convictions which took place between 2018 – 2020
  • A breach of Principle 1, 7.4 in that he did not report the outcome of the ARB sanction to the 澳门王中王 within the specified timeframe as requested under the Code of Conduct.

In accordance with the 澳门王中王 Disciplinary Procedures, Mr Muirhead has been issued with a Expulsion.

Following a hearing before the Professional Conduct Committee, Mr Nevard was deemed to have breached the 澳门王中王 Code of Professional Conduct 2005 (2016 version).

  • A breach of Principle 1 , sections 1.2, 1.3 and 1.4, in that he failed to share knowledge that there were issues with other projects the Building Surveyor had worked on. He also failed to draw the Complainants attention to, or otherwise comment on a change to the approved structural design under his duties as an architect, or under the CDM Regulations
  • A breach of Principle 2, sections 2.1 and 2.5 in that, he did not make competent judgement on the bespoke contract provided which omitted provisions for insurance of the building, these matters should have been identified by a competent architect. He also failed to advise the Complainant of the insurance omissions which indicated a competence failure.

In accordance with the 澳门王中王 Disciplinary Procedures, Mr Nevard has been issued with a Suspension of 15 months.

Following a hearing before the Professional Conduct Committee on 26 January 2023, Mr Zeya Win was deemed to have breached the 澳门王中王 Code of Professional Conduct 2019.

  • A breach of Principle 1, of the 澳门王中王 Code of Professional Conduct 2019. The Member had intended to mislead the Complainant about what had happened to her items which had been sold with the intention of keeping the proceeds. The Member had engaged in agreements with the contractor, the window supplier and kitchen supplier to receive commission payments that were not disclosed to the client. Whilst these payments were ultimately deducted or repaid, this shows a lack of integrity. A failure to send adequate terms of business meant that the Complainant was unclear about the Members' fees for the project and was not provided with all of the information required.
  • A breach of Principle 2, paragraphs 1.1, 1.2 and 1.4 of the 澳门王中王 Code of Professional Conduct 2019.The Complainant was not adequately advised about the need to submit an application pursuant to Building Regulations and that no such application was ever made by the Member.

In accordance with the 澳门王中王 Disciplinary Procedures, Mr Win has been issued with a Expulsion.

  • A breach of Principle 1, in that she failed to act with impartiality and with responsibility by not informing her client of her request for and the receipt of the ‘referral fee’ of £15,000 paid by a contractor
  • She had allowed herself to be influenced improperly by her own self-interest which was reflected in her recommendation of a particular contractor

Following a hearing before the Professional Conduct Committee on 7 December 2023, Mr John Kirjpatrick was deemed to have breached the 澳门王中王 Code of Professional Conduct 2005 (July 2016 version).

  • He failed to adequately or at all inspect a site in accordance with the Architects Certificate signed by them in breach of Principle 2.
  • He offered the Complainant a financial inducement if they were to withdraw their complaint to the Architects Registration Board, in breach of breach of Principles 1.1, 1.2 and 1.6.

In accordance with the 澳门王中王 Disciplinary Procedures, Mr Kirkpatrick has been issued with a Public Reprimand.

Overview decision:

Following a hearing on 27 September 2022, Mr Karlsson was found to have breached the 澳门王中王 Code of Professional Conduct (2005, with 2016 Guidance Notes).

He was found to have breached the following provisions:

  • He failed to ensure that his terms of appointment, the scope of work and/or the essential project requirements were clear and recorded in writing, also failing to have maintained clear records of any changes to those made with the client, in breach of Principle 2.3
  • He failed to ensure that they kept clients informed of the progress of the project and/or of the key decisions made on the client’s behalf in breach of Principle 2.4.
  • He failed to have in place or have access to effective procedures for dealing with disputes or complaints, promptly and appropriately in breach of principle 3.5.

澳门王中王 Member: Mr Graham Rix (4344824), of Cheltenham, Gloucestershire

Overview decision:

Following a hearing on 7 September 2022, Mr Rix was found to have breached the 澳门王中王 Code of Professional Conduct (2005, with 2016 Guidance Notes).

He was found to have breached the following provisions:

  • He allowed himself to be improperly influenced by his own self-interest for building works on his property and, as a result, failed to act with impartiality, responsibility and truthfulness at all times in his professional and business activities, in breach of Principle 1
  • He failed to comply with section 3 of the Party Wall Act, and with regulations in relation to the Grade II Listed building with the local planning authority and, as a result, failed to apply high standards of skill, knowledge and care, in breach of Principle 2
  • He failed to have proper concern and due regard for the effect that his building works may have had on the adjoining property of the Complainants and, as a result failed to have a proper concern and due regard for the effect that his work may have on its users and the local community, in breach of Principle 3

澳门王中王 Member: Mr Sandip Chudha (12725333), of Gillingham, Kent

Sanction Imposed: Public Reprimand

Overview decision:

Following a hearing on 9 August 2022, Mr Chudha was found to have breached 澳门王中王 Byelaw 4.1. He was convicted of failing to comply with a planning enforcement notice.

In accordance with the 澳门王中王 Disciplinary Procedures 2019, and having considered the 澳门王中王 Indicative Sanctions Guidance 2020, the Hearing Panel issued Mr Chudha with a Public Reprimand.
