The °ÄÃÅÍõÖÐÍõ Building Regulations Principal Designer Professional Services Contract 2024 has been specifically written to integrate with the °ÄÃÅÍõÖÐÍõ suite of professional services contracts.
This new contract is suitable for:
- The appointment of a Principal Designer under Part 2A of the Building Regulations, inserted by regulation 6 of the Building Regulations etc. (Amendment) (England) Regulations 2023
- Commissions procured through any form of procurement for commercial projects of any value, including design and build pre-novation, in which the building works will be carried out using bespoke or standard forms of building contract
- An agreement between a Building Regulations Principal Designer and a business client or public authority and is a ‘construction contract’ to which the Housing Grants, Construction and Regeneration Act applies.
The °ÄÃÅÍõÖÐÍõ Building Regulations Principal Designer Professional Services Contract 2024 is not suitable for the appointment of a CDM Regulations Principal Designer. °ÄÃÅÍõÖÐÍõ recommends that a CDM Regulations Principal Designer is appointed under the separate °ÄÃÅÍõÖÐÍõ CDM Regulations Principal Designer Professional Services Contract.
The °ÄÃÅÍõÖÐÍõ Building Regulations Principal Designer Professional Services Contract 2024 is also not suitable for the appointment of a Building Regulations Principal Designer on non-commercial work undertaken for a consumer client, such as work done to a client’s home. Domestic projects are subject to the Consumer Rights Act 2015 and in such cases, °ÄÃÅÍõÖÐÍõ recommends the use of the °ÄÃÅÍõÖÐÍõ Domestic Professional Services Contract, which is being updated to include the provision for the Architect or Consultant to be appointed as the Principal Designer under both the CDM Regulations 2015 and the Building Regulations.
